Terms of Service

2. Summary

This summary is informational only and does not replace the rest of these Terms.

• Ontryst is a dating service for adults aged 18 and over.
• Most of what you see is created by other users; you are responsible for what you post and how you treat other users.
• We do not tolerate child sexual abuse and exploitation, harassment, hate, or fraud, and we will remove content and accounts that break these rules.
• The Service is currently free during our relaunch phase. Paid features may be introduced; if so, they will renew automatically unless you cancel.
• You can end your subscription or delete your account at any time.
• Ontryst is still actively developed; some features may evolve or break, and we will improve them as quickly as we can.
• Our liability is limited; consumer protection laws of your country still apply where they must.

3. Eligibility

To use Ontryst you must:

• be at least 18 years old;
• have the legal capacity to enter into a binding contract;
• not be barred from using the Service under the laws of your country or under these Terms;
• not have been previously suspended or removed from Ontryst.

Ontryst is intended exclusively for adults. Our Child Safety Standards describe our zero-tolerance policy for child sexual abuse and exploitation (CSAE) and the steps we take to keep minors off the platform.

4. Your account

You must provide accurate, complete, and current information when registering, and update it promptly if it changes. You are responsible for safeguarding your login credentials and for all activity that occurs on your account. Notify us at support@ontryst.com without delay if you suspect unauthorised access.

Each person may hold only one Ontryst account. Accounts are personal to you and may not be sold, transferred, or shared. Your membership begins when your account is confirmed by Ontryst.

5. Licence to use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use Ontryst for your personal, non-commercial use.

You may not copy, modify, distribute, sell, rent, reverse engineer, or create derivative works of the Service, except where applicable law expressly permits otherwise.

6. Your content

The Service lets you submit profile information, photos, video, audio, messages, posts, and other content (“Your Content”). You retain ownership of Your Content. By submitting Your Content, you grant Nevolut a worldwide, royalty-free, sublicensable licence to host, store, copy, transmit, display, reproduce, adapt, translate, and otherwise use Your Content for the purpose of operating, providing, and improving the Service, and for safety, moderation, and legal compliance.

You represent and warrant that:

• you own or have all rights necessary to submit Your Content and to grant the licence above;
• Your Content does not infringe any third-party intellectual property, privacy, image, or other rights;
• Your Content complies with these Terms and all applicable laws.

We may review, screen, refuse, restrict the visibility of, or remove Your Content at our discretion, including where we believe it violates these Terms, our policies, or applicable law.

7. Acceptable use

When using Ontryst, you agree that you will not:

• create a fake profile, impersonate another person, or misrepresent your identity, age, gender, or affiliations;
• harass, stalk, threaten, defame, intimidate, or otherwise harm any other user;
• post or transmit unlawful, hateful, discriminatory, violent, or sexually exploitative content;
• post or transmit any content that violates our Child Safety Standards, including any content involving minors in a sexual context;
• solicit money, gifts, or commercial relationships from other users, or run any scam, chain message, or commercial promotion;
• upload viruses, malware, or any code designed to disrupt the Service;
• scrape, crawl, or harvest data from the Service, or use any automated means to access the Service without our prior written consent;
• interfere with, probe, or test the security of the Service or circumvent any access controls;
• use the Service to sell goods or services or to distribute promotional material without our express written permission;
• use the Service for any unlawful purpose.

We may suspend, restrict, or terminate your account for any violation of these rules.

8. Safety and reporting

You may report any user, profile, message, or piece of content that you believe violates these Terms using the in-app “Report” function on every profile and conversation, or by emailing support@ontryst.com. Reports relating to child safety are handled in accordance with our Child Safety Standards and applicable law, including reporting to the relevant authorities.

We use a combination of automated tools and human review to moderate the Service. We may remove content, restrict features, or suspend or terminate accounts based on the results of that review. Where you decide to meet another user offline, please take sensible precautions; Ontryst does not conduct criminal background checks and cannot guarantee the conduct of any user.

9. Subscriptions, payments, and renewals

Ontrystis currently free to use during our relaunch phase. We reserve the right to introduce paid features (“Premium”) during the term of these Terms. When you purchase a Premium feature or subscription, the price, billing period, and renewal terms are shown to you in the Service at the point of purchase, before you confirm payment.

Where you purchase a subscription through the Apple App Store or Google Play, the terms of the relevant store also apply to that transaction, including their cancellation and refund rules.

Unless stated otherwise at purchase, Premium subscriptions automatically renew at the end of each billing period at the then-current price until you cancel. You may cancel at any time:

• for purchases made through Apple App Store: in your Apple ID subscription settings;
• for purchases made through Google Play: in your Google Play subscriptions;
• for purchases made directly through Ontryst: in your account settings or by emailing support@ontryst.com.

Cancellation takes effect at the end of the current billing period; you keep access to Premium features until then.

10. Right of withdrawal (EU, EEA, UK consumers)

If you are a consumer habitually resident in the European Union, European Economic Area, or United Kingdom, you have a statutory right to withdraw from a paid Ontryst subscription within fourteen (14) days of the purchase, without giving any reason.

Ontryst provides paid features as digital content and digital services that are made available to you immediately on purchase. If you expressly request immediate performance and acknowledge that you lose your right of withdrawal once performance has begun, in accordance with Article 16(m) of Directive 2011/83/EU and its implementation in your country, your right of withdrawal will end when you start using the paid feature.

Where you still retain the right of withdrawal, you may exercise it by sending a clear statement to support@ontryst.com within the 14-day period, including the account email used for purchase.

11. Refunds

Except where a refund is required by mandatory consumer law or by the cancellation or refund policies of the App Store or Google Play, paid subscriptions and one-off purchases are non-refundable.

Refund requests for purchases made through the Apple App Store or Google Play must be submitted to those platforms directly, in accordance with their policies. We will assist where we can.

Where we make material adverse changes to a paid feature for which you have already paid, you may cancel that feature and request a pro-rated refund of the unused portion by contacting support@ontryst.com within thirty (30) days of the change.

12. Suspension and termination

You may delete your account at any time through your Ontryst account settings or by emailing support@ontryst.com. Deletion does not automatically cancel any active subscription billed through an app store; you must cancel that subscription separately in the relevant store.

We may suspend, restrict, or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, created a risk to other users or to Ontryst, or engaged in unlawful conduct. Where we do, we will normally notify you by email after the fact, except where notice could prejudice an investigation, the rights of another user, or compliance with law.

On termination of your account, Your Content may, at our discretion, be removed in whole or in part. Provisions of these Terms that by their nature should survive termination will continue to apply, including the sections on Your Content, intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

13. Notifications and service messages

You agree that we may provide you with notices and service messages through the Ontryst application, by email, by SMS, or by push notification, including notices about changes to these Terms, security matters, billing, and account activity. You can manage non-essential notifications in your account settings.

You are responsible for keeping the contact information on your account accurate and up to date so that you can receive these messages.

14. Third-party services

The Service may integrate with or link to third-party services, including app stores, payment processors, identity providers (such as Google Sign-In and Sign in with Apple), mapping services, push notification providers, video/audio infrastructure, and analytics providers. Your use of those third-party services is subject to their own terms and privacy policies, and Nevolut is not responsible for them.

15. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the Service will be uninterrupted, error-free, or secure, that profile information is accurate, or that it will produce any particular result, including any specific match, relationship, or outcome.

We do not conduct criminal background checks on users and we do not verify the statements users make about themselves. You are responsible for taking sensible precautions when interacting with other users, particularly if you decide to meet offline.

16. Limitation of liability

To the maximum extent permitted by applicable law, Nevolut and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Where Nevolut is found liable, its total aggregate liability under these Terms will not exceed the greater of (a) the total amount you paid to Nevolut for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euros (EUR 50) / sixty United States dollars (USD 60).

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for gross negligence, fraud, wilful misconduct, death or personal injury caused by our negligence, or any other liability that mandatory consumer law in your country does not allow us to exclude.

17. Intellectual property

Ontryst, the Ontryst name and logo, the user interface, software, designs, marketing copy, and all other content provided by us (excluding Your Content) are the intellectual property of Nevolut or its licensors and are protected by Congolese, Romanian, European Union, and international intellectual property laws. Nothing in these Terms transfers any of those rights to you.

You may not reproduce, use, publish, distribute, or sell any of the foregoing without our prior express written authorisation.

18. Copyright notice and takedown

If you believe that content on Ontryst infringes your copyright, please send a notice to support@ontryst.com including:

• an electronic or physical signature of the person authorised to act on behalf of the copyright owner;
• a description of the copyrighted work that you believe has been infringed;
• a description of where the allegedly infringing content is located on the Service, with enough detail for us to locate it;
• your contact details, including address, telephone number, and email address;
• a written statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law;
• a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on its behalf.

We will terminate the accounts of repeat infringers.

19. Changes to these Terms

We may update these Terms from time to time. Where the changes are material, we will notify you through the Service or by email at least thirty (30) days before they take effect, and we will update the effective date at the top of this page. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.

If material changes negatively affect a paid feature for which you have already paid, you may cancel that feature and request a pro-rated refund of the unused portion within thirty (30) days of the change.

20. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Democratic Republic of Congo, without regard to its conflict-of-laws rules. The courts of the Democratic Republic of Congo have exclusive jurisdiction, subject always to the paragraphs below.

If you are a consumer habitually resident in the European Union, European Economic Area, the United Kingdom, or another jurisdiction whose consumer-protection law applies to you on a mandatory basis, you also benefit from the mandatory protections of the law of your country, and you may bring proceedings in the courts of your country of residence.

Before bringing any formal claim, you agree to first contact us at support@ontryst.com and attempt to resolve the dispute informally. Consumers in the European Union may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
